Professor Adolf Peter visits CMAC Beijing Headquarter and gives a lecture on ESG and International Commercial Arbitration

On 5 September 2022, Prof. Adolf Peter (CMAC panel arbitrator and associate professor of Shanghai University of Political Science and Law) paid a visit CMAC Beijing headquarter. On behalf of CMAC, Dr. Li Hu (Vice Chairman of CMAC) warmly welcomed him.

Later Prof. Peter gave a lecture on “ESG and International Commercial Arbitration” for CMAC staff. In the lecture, Prof. Adolf Peter introduced the concept of ESG (Environmental, Social and Public Governance) and the European Union’s latest regulatory principles on ESG with case studies. He said that with increasingly complex legal relationships in international supply chains, Chinese companies should pay attention to ESG legal compliance for themselves and their suppliers when engaging in cross-border transactions. He emphasized that arbitration is a great way for contractual disputes caused by international supply chain which often involve extraterritorial enforcement. Supply chain disputes involving multi-parties and multi-contract transactions often lead to multiple proceedings which run the risk of inconsistent decisions and escalated costs. Special-designed arbitration mechanisms such as consolidation of arbitrations and joinder of additional parties will can help minimize this risk, and at the same time, provide a time-and-resource-efficient way of dealing with complex disputes of such nature. Taking the 2021 CMAC Arbitration Rules as an example, he analyzed how to solve supply chain disputes efficiently through consolidation of arbitrations.
